The Court rejects petitions on drug pricing negotiations

The Constitutional Court of Korea (hereafter referred to as the Constitutional Court) made a decision to reject pharmaceutical company¡¯s petition, which alleged a constitutional violation related to the drug pricing negotiations order.

The Constitutional Court recently announced that the clause of a claim, including the violation of the constitution, related to drug pricing negotiation does not fall under the category of exercising governmental authority subject to a constitutional petition. As a result, the request for petition has been declared invalid.
